1. Acceptance of Terms

By using Buchanan Logistics’ website (www.buchananlogistics.com), submitting a rate request, or otherwise engaging our services (freight brokerage, managed logistics, expedited freight, heavy/oversize loads, HAZMAT where applicable, etc.), you agree to these Terms of Service. If you do not agree, you should not use our website or request services.

2. Services Provided

Buchanan Logistics offers full-service freight brokerage and managed logistics solutions — including full truckload (FTL), less-than-truckload (LTL), expedited freight, drop-deck or flatbed when needed, heavy or oversize loads, HAZMAT-certified freight, 3PL managed logistics, and supply-chain support (unrelated to services provided by Buchanan Hauling and Rigging, Inc. unless otherwise contracted to do so as a separate service provider).

3. Quotes, Rate Requests, and Acceptance

All rate quotes, freight pricing, or service proposals provided by Buchanan are estimates based on information available at the time of inquiry (cargo type, weight/volume, origin/destination, special requirements, timing, regulatory constraints, etc.). Such quotes remain valid for the period indicated (or, if none indicated, for 30 days), and are non-binding until confirmed by the customer in writing or agreed electronic form. Changes in shipment details may require a revised quote or trigger adjustments to price and availability.

4. Permits, Compliance, and Customer Responsibilities

For shipments involving heavy, oversized, hazardous, or otherwise regulated cargo, you must provide accurate and complete information (cargo description, classification, special handling requirements, HAZMAT documentation if applicable, origin/destination, delivery timeline, site access, loading/unloading details, etc.). While Buchanan will use reasonable efforts — including our carrier network and compliance personnel — to arrange necessary permits or HAZMAT-compliant carriers, we cannot guarantee permit issuance, regulatory approvals, travel times, or routing.

5. Payment Terms

Invoices are due as specified on the rate quote or service agreement. If payment terms are not specified, payment is due upon receipt. Late payments may result in interest, collection costs, or suspension of future services.

6. Liability & Insurance

Buchanan maintains appropriate cargo and liability insurance for shipments, subject to coverage limits disclosed in each quote or agreement. Our liability for loss, damage, or delay is limited to the amount covered by insurance (or other liability limits specified), except as required by law. Buchanan is not liable for indirect, incidental, or consequential damages — including lost profits, business interruption, or loss of use — even if we have been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold Buchanan, its officers, agents, employees, and affiliate carriers harmless from any claims, liabilities, damages, fines, penalties, or costs (including reasonable attorneys’ fees) arising from inaccurate or incomplete information you provide; improper packaging, labeling, or load securement; prohibited or improperly declared cargo; or failure to comply with applicable laws or regulations.

8. Termination or Refusal of Service

Buchanan reserves the right to refuse or terminate service if you breach these Terms, fail to provide accurate or complete information, fail to obtain required permits or documentation, fail to pay amounts due, or otherwise act in a manner that compromises safety, compliance, or operational integrity.

9. Website Use & Intellectual Property

All content on www.buchananlogistics.com (text, graphics, logos) is owned by or licensed to Buchanan. You may view, download, or print pages for your personal, non-commercial use only. Any other use — including reproduction, modification, redistribution — requires prior written consent.

10. Changes to Terms

We may update these Terms of Service from time to time. The “Last Updated” date indicates the current version. Continued use of our website or services after such changes constitutes acceptance of the updated Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana without regard to conflict-of-law provisions. Any dispute arising under or related to these Terms or your use of Buchanan’s services or website shall be resolved in state or federal courts located in Allen County, Indiana, unless otherwise agreed in writing.
