Buchanan Logistics is committed to providing professional, reliable logistics and freight brokerage services. However, by using our services and website, you understand and accept the following terms (services are unrelated to services provided by Buchanan Hauling and Rigging, Inc. unless otherwise contracted to do so as a separate service provider):
- Freight transport and logistics inherently involve risks: delays, damages, mechanical failure, regulatory or permit delays (especially for heavy, oversized, or HAZMAT loads), carrier availability, weather, or other unforeseen events.
- All quotes, rate estimates, transit time estimates, and delivery windows provided by Buchanan are estimates only, based on the information available at the time of quote. Actual costs, delivery times, routes, and shipment conditions may vary if cargo details, origin/destination, regulatory requirements, or other factors change.
- Buchanan does not guarantee delivery times, transit durations, or absence of delays, damages, or losses.
- You — the customer — must supply accurate, complete, and up-to-date information about your freight (dimensions, weight, classification, special handling, HAZMAT status), origin and destination, required permits, delivery windows or time constraints, loading/unloading site conditions, and any special requirements.
- You are responsible for ensuring freight is properly packaged, labeled, documented (especially for HAZMAT), and ready for transport in compliance with all applicable laws and regulations.
Limitation of Liability
Buchanan’s liability for loss, damage, or delay is limited to the lesser of (a) the amount of proven damage or loss, or (b) the coverage or liability limits specified in our insurance or agreement — whichever is less. We disclaim any liability for indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, business interruption, or loss of use.
No Warranty
All services are provided “as is” and “as available.” Buchanan disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Force Majeure
Buchanan shall not be liable for failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, regulatory delays, permit refusals, carrier breakdowns, traffic, strikes, labor disputes, weather, border crossings, or other force-majeure events.
Quotes & Estimates
All quotes remain non-binding until accepted in writing or by an agreed electronic agreement. Changing shipment parameters may require a revised quote.
Insurance & Additional Coverage
If you require higher cargo insurance or additional liability coverage beyond our standard limits, you must request such coverage in writing prior to shipping; otherwise, our standard limits apply.
By using our services, you acknowledge and accept the inherent risks of freight transport and the limitations described above.
